When is ‘illegal’ not legal in print?

In Coate Tales, Wild Bill talks about John Bidwell being arrested by the then Mexican Authority for being an “illegal immigrant.” Your editorial on the AP’s stylebook notes that the AP is going to stop using the term illegal immigrant.

I have a question. How does the AP plan to distinguish between someone who crossed a border illegally and someone who entered legally then simply stayed or failed to maintain proper documentation of being a resident alien?

An example of the latter was a Brazilian who testified in the Phil Spector trial that came in on a student Visa, got a California drivers license, and stayed.
