Supervisors must decide to settle or face litigation
The City of Fresno plans to sue Madera County tomorrow if the Board of Supervisors does not agree to enter into a tolling agreement regarding the Tesoro Viejo development project planned for the eastern part of the county.
In a closed session Nov. 29, the Fresno City Council voted 5 to 2 for city attorneys to submit a request for a tolling agreement to Madera County Counsel, said council president Clinton Olivier.
David Hale, chief assistant Fresno city attorney, said it is up to the Madera board to approve the tolling agreement to stop litigation.
“Hopefully the City and County can sit down and discuss any issues those bodies might have. The tolling agreement suspends any litigation,” he said. “December 5 is when the city will be filing if a tolling agreement isn’t entered into. We will probably be suing under CEQA over the environmental document. We are doing an analysis on that now, but it’s premature to discuss any details.” ...
