The Madera County District Attorney’s Office has decided not to proceed with a criminal fraud case against former Chowchilla mayor and longtime area businessman Thomas Dubose, DA Michael Keitz said Thursday.
“That being said, it is not a statement or finding of innocence (in this case). As prosecutors we must prove our case beyond a reasonable doubt, which is the highest burden of proof,” Keitz said. “Based on the state of the case, and after careful review, we determined that we could not present a case to the jury, at this time, that would meet this burden.”
Dubose was arrested in July on multiple charges of fraud and grand theft, and for allegedly filing false financial statements, in conjunction with several real estate deals with the City of Chowchilla and two other local real estate holding corporations.
“We have worked closely with the victims and they are aware of the civil remedies available to them,” Keitz said. “Should the evidence change, our office will consider refiling charges.”
